LAKE COMMITTEE

The Lake Committee was established by Article X, Section 25, Paragraph B of the restrictive covenants to govern the rules, regulations, actions and financial needs of Emerald Lake and its use.  Lake Committee members have special lake use privileges, such as boating access and exclusive use of the boat ramp. 

CLASS A MEMBERS

Class A Members consist of the "Declarant" (Plainsmen Development, Inc.) and its successors and/or assigns.  The "Declarant" has 3 votes for each parcel or property owned. 

CLASS B MEMBERS

Class B Members consist of all property owners whose parcels or property abut or have a boundary line adjoining the lake shoreline, or which parcel or property extends into the lake (e.g. lakefront property owners).  Class B members have 1 vote for each parcel or property owned.  

AFFILIATE MEMBERS (NON-VOTING)

10 Affiliate Membership slots were created for inland residents by the Lake Committee by majority vote via ballot in January 2008.  Affiliate Members are given limited boating privileges (no ski boats) and may participate in meetings but are ineligible to vote.  For complete details on Affiliate Membership financial obligations, benefits, and restrictions, please download and read the application materials below.  Memberships are assigned on a first-come, first-served basis and are non-transferable.  Interested parties should contact the Lake Committee Chairman for membership slot availability.

MEMBERSHIP DUES, SPECIAL ASSESSMENTS AND USER FEES

All Lake Committee members are required to pay an annual fee in the amount of $125 (collected with the Foxchase Residential Association annual assessment).  Affiliate Members are also required to pay a one time, non-refundable initiation fee of $50.  This fee structure is subject to increase to meet the financial needs of Emerald Lake and the Lake Committee. 

The Lake Committee may levy a "special assessment" in any amount to meet expenses not covered by initiation and annual fees.  Such "special assessments" require a 2/3 approval vote of participating voting members. 

Presently, bankside fishing is available from Foxchase Residential Association property to all residents at no charge.  However, the Lake Committee reserves the right to charge fees to non-members for lake use (such as a fishing fee) in the future to help defray the rising costs of stocking and maintaining Emerald Lake.
